SIDEWALK POLICY

Goal & Purpose

The goal of this policy is to create guidelines for property owners in the City of Kennedy in regards to the repair and replacement of sidewalks with an emphasis on public safety while maintaining fiscal responsibility.

Permanent Sidewalks

The sidewalk running parallel to US Highway 75 shall be designated a permanent sidewalk. With this designation, the City of Kennedy has determined that this sidewalk is beneficial to the community has a whole and will be maintained and repaired with general tax dollars. Replacement of sidewalk, curb and gutter will be funded by the General Fund of the City of Kennedy and a request put into MNDOT for cost sharing.

Repair and Replacement

As sidewalk replacement and repair is expensive, the City of Kennedy must use discretion and professional judgment in determining when and where sidewalks need to be replaced or repaired.

Removal without replacement

Removal of a sidewalk, without replacement, shall occur if the abutting property petition the City of Kennedy and the City Council determines it is in the best interest of the public to remove the sidewalk without replacement by Resolution, and the motion passes by a three-fifths vote. The City Council can, on its own motion, seek the removal of a sidewalk without replacement by Resolution, and the motion passes by a three-fifths vote.

Replacement

If a property owner would like to replace sidewalk on the abutting property, they may do so with council approval by Resolution. Upon approval, the property owner will be assessed 100% of the costs to replace the sidewalk. The replacements costs may be assessed to the property owner over a period of three years plus interest.

Curb Cuts & Driveway Approach

All curb cuts and driveway approaches that are repaired benefit the affected property only. The property owner will be responsible for 100% of the cost incurred in the repair without an option to have the repair assessed to the property over a period of time. The City of Kennedy will be notified prior to any repairs as to monitor the project to ensure the area is returned to original specifications.
